How Amazon FBA Bin Checks Can PROVE Product Authenticity for Sellers with Counterfeit Claims

Hi everyone. My name is Alexa and I'm a paralegal here at Rosenbaum, Famularo & Segall, PC. And today I'm here to talk to you about one of my recent successes.

So a client came to us with a counterfeit complaint and had previously gone to Amazon with their invoices, to prove that their products were authentic, but for whatever reason, Amazon wasn't accepting their invoices. So I suggested that we write to the inventory team and request they perform a bin check. Now, these bin checks are internal reviews by Amazon, pretty much saying, we're going to look through the bin that belongs to you as a seller, or the shelf that you own as a seller for the specific issue and by going through it, they can verify its authenticity.

Now, I don't know if this can be done for every product, but for this particular product, the inventory team responded within a week, a week and a half, and provided a response saying that the inventory was able to be removed by the client, meaning it was not counterfeit. Amazon will hold on to inventory that is counterfeit, so if that is a situation you find yourself in, you may not be able to remove your inventory, so be aware of that. But by performing this bin check, this client was able to not only have this notification so that they could remove this inventory, but then we use this notification to appeal again, and that eventually led to the ASIN being reinstated itself.
